Project Overview:
Bechtel and Westinghouse Electric Company have partnered to deliver the first AP1000 nuclear power reactors in Poland for our customer, the Polish Entity Polskie Elektrownie Jadrowe (PEJ). Bechtel will be the Engineering, Procurement, and Construction (EPC) contractor for the project. As the EPC, our responsibilities will include providing the design for the Turbine Island and Balance of Plant as well as the construction of the entire facility. This is a one-of-a-kind opportunity, and we are looking for the talent that will help expand Poland’s nuclear base and build a strong and long-lasting energy future for generations to come. This position is subject to U.S. Department of Energy (DOE) regulations at 10 CFR Part 810 (Part 810), which govern the transfer of hardware, materials, and technology to support the construction and operation of commercial nuclear power plants overseas.
Job Summary:
As the Senior Prime Contracts Professional in Warsaw, you will support effective administration and management of the prime contract agreement between the Customer and Bechtel. The position reports operationally to the Prime Contracts Manager and functionally to the Global Business Unit (GBU) Manager of Prime Contracts. Duties and responsibilities include implementation of the Prime Contract Management Program and ongoing related training, monitoring, compliance with project/prime contract completion requirements and status. In consultation with GBU Management/Legal, facilitate strategies for effective management of project commercial matters, including creation and capture of contemporaneous records.
Major Responsibilities:
• Administers cost reimbursable or lump sum/fixed price contract to assist the Prime Contracts Manager and/or Project Director/Manager in managing a medium risk, medium to high technical or commercial complexity project
• With the project team, identifies the contract baseline, including terms and conditions, specifications, drawings, estimate, proposal, schedule, and other documents incorporated in the contract
• Develops and maintains the prime contract management processes, procedures, tools, and training as outlined in the Prime Contract Management Manual and related business unit functional procedures, including the Prime Contract Management Responsibilities Matrix, the Prime Contract
• Action/Notice List/Liability Containment Plan/Flowdown Matrix (or comparable tools) identifying the specific contract actions and obligations of Bechtel and the customer and the individual responsible for each action
• Establishes tools and/or uses & maintains records and systems required by Customer and/or partners in Joint Association arrangements
• Develops suitable materials/systems to manage key issues, bespoke contract requirements, e.g., for incentive/Key Performance Indicator regimes, bonus/incentive, penalties
• Prepares an analysis of the prime contract general terms and conditions to highlight areas of potential risk such as ambiguities, omissions, and conflicts
• As work proceeds, assists the Project Director/Manager in mitigating those risks that arise
• Monitors closely and supports remedial actions as necessary and recommends appropriate tradeoffs to the Project Director/Manager
• Establishes a Project Prime Contract Change Management Procedure, incorporating the Pending Item Program, to provide a methodology to identify changes, quantify the additional time and compensation due Bechtel per the contract, define approval requirements and communicate changes to the Customer; prepares and negotiates change orders as directed
• Participates in project related meetings, works closely with Construction, Engineering, Supply Chain, and Project Controls, and reviews project financial data to ensure awareness of all project activities that may affect the prime contract, identifies opportunities for revenue enhancement, schedules relief and claim avoidance, recommends appropriate actions to protect Bechtel’s interest and/or improve project performance, and ensures compliance with prime contract terms and conditions
• Responsible for coordinating with the project team to ensure the timely development of, and responses to, project correspondence.
• Develops a program to identify and prepare claims as they develop and direct the efforts to negotiate and resolve claims in coordination with the Claims Group and Legal Department
• Responsible for adherence to contract insurance provisions and coordinates any requirements in this regard with responsible organization and Corporate Risk Management personnel
• Works with Risk Management organization on any occurrences that may be covered by Customer or Bechtel provided Insurance
• Coordinates the handling of prime contract closeout requirements
• Contributes to the development and delivery of ongoing training to address prime contract management principles and identification of claims
• May perform similar duties on a retrospective basis while assigned to the Claims Group
Education and Experience Requirements:
- Requires bachelor's degree (or international equivalent) in any of these academic studies listed: construction management, business, legal, cost engineering, finance, procurement-focused degree programs, along with 10-13 years of relevant, professional experience.
Required Knowledge and Skills:
• Must be able to live and work in country, without sponsorship
• Excellent oral and written communication in both English and Polish.
• Extensive knowledge of managing customer/prime contracts with similar commercial terms and incentivization models (e.g. EPC Contractor, Cost Reimbursable, Target Cost/Schedule and Performance Guarantees).
