Project Description:

Saudi Arabian Bechtel Company provides project management consultancy services (including technical, commercial and construction management) for the development of certain defined aspects of the NEOM Project in the Kingdom of Saudi Arabia.”  

 

NEOM is a planned cross-border city in the Tabuk Province of northwestern Saudi Arabia. The site is near the Red Sea and the borders of Egypt, Israel and Jordan. It will cover a total area of 26,500 km2 (10,200 sq mi) and will extend 460 km along the coast of the Red Sea.”

It will include towns and cities, ports and enterprise zones, research centers, sports and entertainment venues, and tourist destinations. Detailed Job Description

Summary:

Seeking candidates experienced with managing the contracts and procurement function for a project from inception through completion. Functional scope includes supporting development of the project contracts strategy, administration of the prime contract between Bechtel and its Customer, (sub)contract formation, (sub)contract administration, and claims. 

 

Takes functional operations role with regards to contracts and procurement team, sourcing, evaluating, proposing and onboarding candidates. Functional development of Contracts and Procurement staff through training and mentoring. Manages Contracts staff assigned to the project.

 

Significant proactive engagement required with the project management team, customer project team, other customer stakeholders and external stakeholders to enable successful alignment on systems, processes, procedures, and the critical activities for project success.

 

Job Dimensions:

  1. Engage with the project management senior team and Customer to develop and align strategy, methods and controls for the safe and successful project work performance 
  2. Team management, guidance and development to effectively resolve change events, claims and disputes fairly including coordination with Legal as may be required.
  3. Team player that can direct and receive guidance and feedback.
  4. Reports to the Commercial Director.
  5. Receives functional guidance from and supports the mission of the responsible GBU Manager of Contracts and Procurement.

 

Job Duties:

General

Deputizes for Commercial Director when on rotational leave and other occasions as required.

Functional Management

  1. Operate as an extension of the Bechtel Infrastructure Manager of Contracts & Procurement to support the project’s diverse and rapidly growing Contracts team.
  2. Lead Contracts staffing efforts to define and communicate personnel requisitions from the project team and coordinate fulfillment activities with Contracts Managers responsible for candidate selection. Bechtel is acted to diversity.
  3. Lead project onboarding and training delivery responsibilities for Contracts personnel joining the project. Present training modules on project as needed or requested by the Project Commercial Manager and Infrastructure C&P Functional Manager.
  4. Develop and implement measures to monitor and assess the quality of the Contracts group on the project and recommend improvement opportunities.
  5. Evaluate project Contracts processes and procedures, provide recommendations to fill gaps or enhance performance, engage functional and project management when required and implement performance monitoring measures.
  6. Support the Project Commercial Director to provide project oversight and perform reviews of processes, procedures, practices, performance, personnel, interfaces, and deliverables.
  7. Provide in-person touchpoints for project personnel to supplement the career development, performance, and assignment planning activities performed by off-project functional managers.

 

Prime Contract

  1. Provide support and guidance to the Commercial Director and/or Project Director in the management of the prime contract; work with the project management team to identify the prime contract baseline, to identify project opportunities and risks, and to develop a risk mitigation plan.
  2. Participate in project related meetings, work closely with Construction, Engineering, Procurement and Project Controls, and review project financial data to:
  3. Ensure awareness of all project activities that may affect the prime contract.
  4. Identify opportunities for revenue enhancement, schedule relief and claim avoidance.
  5. Take appropriate actions to protect Bechtel’s interest and/or improve project performance.
  6. Ensure compliance with prime contract terms and conditions.
  7. Direct support to the Commercial Director and/or Project Director for the preparation and negotiation of changes to the baseline contract as well as the resolution of constructive contract changes with respect to additional compensation and time.
  8. Provide for adherence to contract insurance provisions and coordinate with the Risk Management Department on any occurrences covered by Customer or Bechtel provided insurance.
  9. Direct support to the Commercial Director for the management of Bechtel’s contractual and commercial interests in connection with joint venture and other similar relationships.
  10. Develop a program to identify and prepare claims as they develop and direct the efforts to negotiate and resolve claims in coordination with the Claims Group and Legal Department.

 

Pre-Award of Contracts / Agreements

Supports the development and issuance of contracts and services agreements including the following activities such that the team:

  1. In accordance with NEOM project procedures, work with NEOM team to deliver tender process from beginning to end; forming and issuing tender packages, tracking and closing queries, receiving and evaluating proposals, and providing recommendations for award
  2. Develop procurement strategy with consideration of finance opportunities.
  3. Ensures meetings/workshops, such as bid clarification and pre-award meetings, are held for the purpose of ensuring complete understanding and agreement between Bechtel, the client, and contractor on all contractual matters. 
  4. Responsible for preparation of contract documents for execution with Customer’s Legal team.
  5. Prepares and maintains control and status reporting documents.

 

Post-Award of Contracts / Agreements

Supports the contracts teams responsible for:

  1. The implementation of Contract & Commercial Management Procedures for the administration of the Contract.
  2. The review of Contract general terms and conditions to identify and monitor areas of risk, ambiguities, conflicts or deviations from the scope of work. 
  3. The development and management of appropriate mechanisms to monitor compliance with contract terms and conditions.
  4. Identification and resolution of Contract claims as they develop, including engagement of corporate legal department where necessary.
  5. Obtaining all contract deliverables for timely work handover and close-out of contracts.

 

Qualifications/Experience

Essential Skills:

  • Degree in Business, Quantity Surveying, Law or Engineering.
  • Experience in delivering training on contract formation, pricing, contract law, contract administration, change, effective correspondence, planning and scheduling.
  • Thorough knowledge of prime contract administration as well as contract/(sub)contract formation and administration, execution office and field procedures, and documents relating to a multi-discipline construction project.
  • Demonstrated leadership and teamwork capabilities suitable for managing a workforce of many nationalities and backgrounds.
  • Direct experience interviewing / personnel selection, salary planning, performance evaluations, career counseling and resource allocation.
  • Extensive skill in working and informing effectively, both orally and in writing, with other project functional groups, Customers and Stakeholders.
  • Minimum 20+ years’ experience in Commercial or Contracts Management of projects to mega-project size.

 

Preferred Skills:

  • Team Leadership of 10+ years
  • Experience of contract finance options.
  • Experience in Middle East / Saudi Arabia
  • Arabic Language, Managing Large Teams etc.
