Job Summary:

The role involves independently handling legal compliance/reporting/filing obligations related to labor and employment (“L&E”) laws at federal and levels across all Company locations in India including pertinent Shops & Establishments acts, industrial establishment acts, Industrial Employment (Standing Orders) acts, Employees’ Provident Funds & Miscellaneous Provisions Act, Contract Labor (Regulation and Abolition) Act, Payment of Gratuity Act, Maternity Benefit acts, Employees Compensation Act,  Payment Of Bonus Act, the POSH Act, Rights of Persons with Disabilities Act, Industrial Disputes Act, and corresponding rules and municipal codes.

 

The individual will serve as the primary point of contact for ensuring compliance with reporting/filing/registration requirements under all applicable L&E laws across all offices of the company in India. Additionally, the role provides support to Senior Counsel, Global Labor & Employment on various L&E matters. Close collaboration with Human Resources, Finance, Compliance, and legal personnel is a key part of the role.

  • Supervision: Reports to Senior Counsel, Global Labor & Employment and operates with minimal guidance, receiving overall direction on key matters.
  • Contact: Maintains regular communication with Legal, India management, global teams, and HR to ensure L&E compliance across the organization.
  • Key Responsibilities: Ensures regulatory compliance with all applicable L&E laws. Provides necessary information for L&E compliance matters and collaborates with relevant stakeholders.
  • L&E Compliance: Monitors changes in relevant laws and, in consultation with Senior Counsel, Global Labor & Employment, advises India Management on legal implications and required actions to maintain compliance. 

Major Responsibilities:

  • Preparing and submitting forms/documents required by applicable L&E laws to pertinent government offices/agencies.
  • Obtaining necessary certifications with regard to applicable Standing Orders.
  • Maintaining knowledge/awareness of L&E regulatory requirements and compliances and driving such compliances across all offices and operations of the Company in India, specifically local labor law and service establishment related legislations, including anticipated changes in L&E laws and providing advice to Senior Counsel, Global Labor & Employment on implications and appropriate actions.
  • Assisting with compilation of L&E compliance information/documents as needed to respond to governmental authorities.
  • Advising directors on L&E legal responsibilities and responsibilities under policies, drafting related documents, and handling director queries regarding such responsibilities.
  • Working with Senior Counsel, Global Labor & Employment to manage timely responses to policy approvals.
  • Assisting internal stakeholders in communication with government agencies to ensure compliance with L&E law reporting inquiries.
  • Filing statutory forms under applicable local labor law and service establishment related legislations laws and ensuring compliance with these regulatory frameworks.
  • Collating of information for inspection by labor authorities and providing authorized persons with access to company labor records.
  • Obtaining Board approvals, as needed to facilitate Company’s responses to government authorities.
  • Monitoring and advising on changes to relevant legislation, consulting with the Senior Counsel, Global Labor & Employment, and ensuring that the company remains compliant with evolving legal frameworks in the labor/employment law areas.
  • Liaising with external regulators under different L&E laws.
  • Monitoring regulatory changes and advising on necessary actions to ensure continued compliance with new and existing regulations.
  • Contributing to a wide range of additional L&E matters as needed.

Education and Experience Requirements:

  • A minimum of 5-8 years of experience in L&E legal compliance roles in law firms or in-house counsel teams.  Compliance related certifications and experience with a multinational company operating in India will be preferred. Experience in managing L&E compliance for foreign-held entities in India will be an added advantage.

Required Knowledge and Skills:

  • Strong knowledge of Indian labor laws especially for the states of Haryana, New Delhi, Gujarat, Maharashtra and Tamil Nadu, office administrative and business regulations, and other service establishment-related laws with a demonstrated ability to ensure compliance.
  • Proficient in using technology tools, including hardware and software applications, that support compliance activities.
  • Excellent verbal and written communication skills, with the ability to communicate complex legal and regulatory information clearly to all levels of management, employees, and external stakeholders.
  • Strong interpersonal skills with the ability to collaborate effectively across departments, manage relationships with external advisors, and interact with diverse stakeholders, including senior management.
  • Strong organizational skills, with the ability to manage multiple tasks and deadlines effectively, ensuring compliance and smooth secretarial operations.
