Project Overview:
Bechtel is building a semiconductor manufacturing plant in New Albany, Ohio. We are partnering with the North America Building Trades Unions and suppliers to create several thousand new jobs and work with local education organizations to implement new training programs that will support the future talent pipeline. Bechtel Manufacturing & Technology, Inc. offers engineering, procurement, and construction services for customers in the semiconductor manufacturing, electric vehicle, and data center markets. Headquartered in Reston, Virginia, the M&T global business unit also includes colleagues working in Arizona, Ohio, Texas, India, and additional project locations around the world.
Job Summary:
In this role, you will participate in subcontract formation and/or administration. Subcontract formation includes leading preparation and review of bid request packages and developing project contracts operating procedures. Subcontract administration includes continual progress review, forecasting, and communication of difficulties. Your work will ensure subcontract compliance with project requirements. Performs all phases of tasks involved in the sourcing, formation, tendering, negotiation and award and administration of EPC subcontracts. Communicates with bidders and personnel within Bechtel to establish clear definition of requirements and to assure proper performance to the stated project requirements. Maintains a continuing review of the progress of each subcontract and provides management with information regarding any scope budget, financial, legal or technical difficulties. Prepares change order and amendments, negotiates with subcontractors and customers to obtain settlement. Represents the company at all times with high moral standards and ethics.Specific to this position, will interface with Subcontractors to communicate implementation of, and compliance with, the Davis-Bacon and Related Acts (DBRA) (40 USC §3141 et seq.; 29 CFR Parts 1, 3, 5, 6 and 7) including DBRA’s prevailing wage requirements in conformance with the CHIPS and Science Act (CHIPS Act). #LI-RG1
Major Responsibilities:
- Reports to and receives operational direction from Project Contracts Manager
- Receives functional guidance from Manager of Supply Chain
- Maintains working relationships with the Project Management Team (PMT) and customer personnel to ensure Contracts actions are consistent with customer/project goals
- Maintains working relationships with members of project team and other Services (e.g. Legal, Finance etc.) as needed
- Maintains contacts relationship with applicable Business Unit Supply Chain Functional Management and with strategic subcontractors
- Engage as part of the project management senior team and/or with the Customer to develop and align strategy for the safe and successful execution of project
- Prepares, coordinates and contracts inputs for proposals
- Define and develop the scope of Contract Work, contract assignment schedules and division of responsibility matrix (DOR), preparing procedures, schedules, forecasts, budget and monitors them.
- Coordinates Contracts inputs to the preparation and/or modification of the project’s prime contract. Prepares and/or directs preparation of general, special, and pricing conditions of the master Contract pro-forma documents
- Assures that project contracting strategy is consistent with Bechtel Directives, Management Instructions, and Contracts Procedures.
- Leads and performs the development, issuance and administration of contracts and services agreements for the complete life cycle
- Prepares Contracts workhour requests with the assistance of functional personnel. Monitors project contracts workhour expenditures to ensure operations are within approved budgets.
- Coordinates Contracts execution plan with Engineering and Construction plans and start/up commissioning and operations
- Analyzes and highlights areas of risk such as ambiguities, conflicts or deviations from the scope of work. As work proceeds, make recommendations to the Project Management Team on the mitigation of these risks; closely monitor and support remedial actions and recommend appropriate tradeoffs.
- Responsible for the development and management of appropriate mechanisms to monitor compliance with contract terms and conditions.
- Responsible for the management and identification of Contract claims as they develop and manage the timely resolution under the change provisions wherever possible, obtaining claims and legal expertise as appropriate.
- Indoctrinates newly assigned Contracts personnel to the requirements and procedures of the corporate, global business unit, project, and client. Monitors personnel to ensure they receive appropriate training and development.
- Plans and directs the orderly close out of contracts operations.
- Team management, guidance and development to effectively resolve change events, claims and disputes fairly including coordination with Legal as may be required
Education and Experience Requirements:
- Requires bachelor's degree (or international equivalent) in relevant field and 2-5 years of relevant experience or 6-9 years of relevant work experience in lieu of a degree.
Required Knowledge and Skills:
- Knowledge of service acquisition & procurement regulations, policies and practices.
- Demonstrated training or experience in pricing, contract law, negotiations and accounting.
- Working knowledge of engineering/construction industry contracting practices.
- Experience in developing contract types (including LSTK, T&M and UR), fee arrangements and contract terms.
- Experience in developing and recommending potential solutions to contractual problems to management.
- Broad knowledge and experience in subcontract administration required.
- Strong organizational and communication (oral and written) skills, professional and proactive approach to mitigation of contract administration challenges and inherent business risks.
- Knowledge of developing and implementing strategies for negotiations utilizing accounting or cost engineering methods gained through education or experience.
- Knowledge and understanding of the project functional groups and company policies, procedures and work practices, as well as associated software systems.
- Experience in field administration of EPC contracts is an asset. Minimum 5 years in (sub)contract administration.
- Proficiency in all phases of the formation and award of large, moderately complex contracts.
- Experience on large scale U.S. Government funded projects requiring implementation and compliance with DBRA requirements and familiarity with Bechtel internal compliance procedures.
