Subcontract and Claims Administrator

PROJECT OVERVIEW

Pennsylvania Chemicals is a world-scale facility that will use ethane to produce 1.6 million tonnes of polyethylene per year. The project will involve up to 6,000 workers during its construction and is expected to employ 600 permanent employees when completed. The ethylene / polyethylene complex will be located in the Ohio River Valley north of Pittsburgh. It comprises an ethane cracker and three polyethylene units, plus OSBL including a gas-fired combined cycle cogeneration unit and a large storage-in-transit rail yard.

 

SUMMARY

Responsible for review and analysis of (sub)contractor and/or vendor emerging risks and formal claims as required. Coordinates with other departments as required to complete the assessment, and prepares a summary of facts, negotiation plan(s), and possible outcomes. 

Additional job duties may include supervisory and/or administration of large moderately complex (sub)contracts.  Maintains a continuing review of the progress of each (sub)contract and provides management with information regarding any financial, legal or technical difficulties.  Prepares change order and amendments, negotiates with (sub)contractors and customers to obtain settlement.

EFFECTIVE JOB DUTIES

    1. Administers assigned (sub)contracts maintaining a continual review of progress and providing management with information regarding projected financial or technical difficulties.
    2. Coordinates with designated staff on operational activities affecting contractual rights and obligations, (sub)contract performance, (sub)contract administration and other major matters.
    3. Administers moderately to highly complex contract changes by developing solutions, preparing recommendations, negotiating with customer personnel, and obtaining settlement.
    4. Represents Bechtel in contractual discussions of moderate to high complexity.
    5. Administers information programs to ensure mutual understanding of (sub)contract terms and conditions.
    6. Prepares periodic status reports for management.
    7. Assist (sub)contract administration team on potential disputes and claims identification.  Review correspondence and identify areas of vulnerabilities to future disputes/claims.  Develop strategy to defend and start collection of data needed to defend if claims materialize.
    8. Experience in the analysis and evaluation of construction-related claims and disputes. Be able to thoroughly assist in assessing or validating entitlement and quantification of damages thus promoting a successful resolution in an efficient and timely manner.  Be able to package positions into presentations, letters and reports.
    9. Analyze each party’s positions and formulate the strategy to defend, including recommended settlements and settlement options.  Collect data as needed and have team supply needed.
    10. Coordinate with Legal and Risk Management to obtain and provide information regarding contract issues. 
    11. Negotiate/settle claims once parameters of settlement approved by Project Management and Client.
    12. Self-motivation with effective time management skills.
    13. Ability to work effectively in a professional team environment.
       

JOB KNOWLEDGE

  • Knowledge of contracts and procurement regulations, policies and practices.
  • Knowledge and experience in contract law, (sub)contract formation, administration, negotiations, claims, cost, scheduling, and accounting.
  • Working knowledge of engineering/construction industry contracting practices and Bechtel policies, procedures and work practices.
  • Demonstrated oral and written communication skills.
  • Technical and administrative knowledge of all phases of Fixed Price, Unit Price, and Cost Reimbursable (Sub)Contract management.
  • Experience in developing and recommending potential solutions to contractual problems to management.
  • High level of technical writing skills with ability to summarize complex commercial issues into succinct written report including relevant technical details.

Grade 26

Administers complex (sub)contracts.  Extensive knowledge and experience in (sub)contract administration required.  Represents Bechtel in (sub)contract negotiations.

 

Grade 27

Possesses extensive knowledge and experience in (sub)contract management and applies that knowledge and experience to improve project performance.
