Project Overview:

Bechtel is seeking to work with a major Indian corporation to provide Project Management Consultant (PMC) Services and Engineering Procurement and Construction Management (EPCM) Services for offsites and utilities (OSBL) for a multi-billion-dollar upgrade / expansion of their existing petrochemical facilities in India. The PMC Services will be led out of India with personnel deployed in Mumbai region, the project sites in India, as well as several key contractor locations across India. The EPCM Services for OSBL will be led out of Bechtel’s India offices. Both scopes are substantial with multi-million job-hours estimated across both scopes.

 

Summary:

Manages the contracts function for a project from inception through completion.  Functional scope includes development of the project contracts strategy, administration of the prime contract between Bechtel and its Customer, (sub)contract formation, (sub)contract administration, and claims.  Manages Contracts staff assigned to the project.

  • Provides operational direction, technical and functional guidance to the project contracts and claims personnel and other personnel in the performance of contracts or claims tasks as found with Project Management, Construction and Procurement.

  • Customer representatives and contracts staff and contracting company managers

 

Essential Job Duties:

  • Develop the contract strategy for the project based on applicable laws and Bechtel’s license(s) in the executing location(s), Customer requirements, and the overall project execution strategy considering project risk, pricing, scope, and schedule.  Use the contract strategy to prepare and implement the project contract execution plan.
  • Provide support and guidance to the Project Manager in the management of the prime contract:  work with the project management team to identify the prime contract baseline, to identify project opportunities and risks, and to develop a risk mitigation plan.
  • Develop a Prime Contract Management Program for the project consistent with the practices and procedures set forth in the Prime Contracts Management Manual, and communicate the baseline and the program to all members of the project team.
  • Establish and implement the project contract/(sub)contract formation and contract/(sub)contract administration programs and ensure compliance to applicable Bechtel policies (e.g. Policy 230, Policy 102);
  • Provide ongoing guidance in the various aspects of contract management to the Project Manager and key members of the project team to ensure that sound prime contract management and (sub)contract formation/administration principles are applied throughout the contracts work process;
  • Develop and implement the project Contract staffing plan and provide training, technical guidance and development to Contract staff assigned to the project team;
  • Participate in project related meetings, work closely with Construction, Engineering, Procurement and Project Controls, and review project financial data to:
  • Direct support to the Project Manager for the preparation and negotiation of changes to the baseline contract as well as the resolution of constructive contract changes with respect to additional compensation and time;
  • Provide for adherence to contract insurance provisions and coordinate with the Risk Management Department on any occurrences covered by Customer or Bechtel provided insurance;
  • Direct support to the Project Manager for the management of Bechtel’s contractual and commercial interests in connection with joint venture and other similar relationships;
  • Develop a program to identify and prepare claims as they develop and direct the efforts to negotiate and resolve claims in coordination with the Claims Group and Legal Department;
  • To execute the (sub)contract plan, research and prepare recommendations and reports for contracting for major services, taking into consideration legal, commercial, and financial factors; maintain an awareness of current conditions throughout the life of the project;
  • Participate in the development of the project bidders list.  Ensure it is maintained in an up-to-date manner and contains qualified suppliers and contractors approved by the Customer when required by the Prime Contract;
  • Reviews and approves bid tabulations and recommendations consistent with both customer and project interests;
  • Participate in the development and ensure the implementation of the Contracts Management Divisions of Responsibilities;
  • Ensure the monitoring of contract quality, cost and performance and that all contractual duties and obligations are met by all parties to each (sub)contract.

 

Job Knowledge:

  • Degree in Business, Quantity Surveying, Law, Engineering, Construction Management or Cost Engineering, or equivalent.
  • Demonstrated experience in pricing, contract law, contract drafting, administration and negotiation of change orders, effective correspondence, planning and scheduling
  • Thorough knowledge of prime contract administration as well as contract/(sub)contract formation and administration, execution office and field procedures, and documents relating to a multi-discipline construction project.
